Olson v. Anderson
Docket Number: 72457
Las Vegas - 10:00 A.M. - Court of Appeals
Appellant Kenneth Olson challenges a district court order denying his petition for judicial review of an administrative proceeding in which he was denied workers’ compensation benefits. Olson claims to have gone blind in both eyes as a result of exposure to toxic chemicals during the course of his employment with Respondent Anderson Dairy. Anderson Dairy’s industrial insurance carrier, Respondent Travelers Insurance, denied Olson’s claim for benefits, and both the Nevada Department of Administration and the Eighth Judicial District Court affirmed the denial. Olson now appeals.
ISSUES:
(1) Did the district court engage in the appropriate level of appellate review with respect to Olson’s petition for judicial review? (2) Was the decision of the Department of Administration appeals officer supported by substantial evidence? (3) Did the appeals officer apply the wrong legal standard at the hearing? (4) Did the appeals officer abuse his discretion by failing to order an independent medical examination?
