This is an appeal from a district court order granting a motion to dismiss and an order granting a motion for reconsideration resulting in dismissal of the remaining claim. Appellant argues that he successfully pleaded that respondent Cardinal Health undertook performance of Controlled Distribution Program agreements for his benefit and breached that duty by allowing respondent NDOC to obtain drugs that it should have been precluded from purchasing. With respect to the order granting the motion for reconsideration, appellant argues that the district court applied an incorrect legal standard and that he successfully pleaded the underlying claim for false pretenses.

This appeal involves a constitutional separation of powers question. At the district court, appellant argued that members of the Nevada Legislature who are concurrently employed by the executive branch or by a local government violate the separation of powers provision. The district court granted respondents’ motions to dismiss for failure to state a claim upon which relief may be granted. Appellant argues that the district court erred and asks this court to hold that the constitution prohibits executive branch and local government employees from concurrently serving in the Nevada Legislature.
