Leavell (Ronald) vs. Dist. Ct. (State)

This is an emergency petition for a writ of mandamus challenging a district court’s denial of a pre-trial petition for a writ of habeas corpus. The State charged Petitioner Ronald Leavell with second-degree murder with use of a deadly weapon in connection with a fatal collision Lavell allegedly caused while driving at excessively high speeds in a residential neighborhood, allegedly under the influence of marijuana.
ISSUES:
Leavell contends that the second-degree murder charge should be dismissed as preempted by Nevada’s Uniform Traffic Laws, and seeks an order of mandamus directing the district court to dismiss the second-degree murder charge and grant Leavell’s habeas petition.

Robinson (Darrius) vs. State

This is an appeal from a judgment of conviction, for burglary while in possession of a deadly weapon and robbery with the use of deadly weapon, pursuant to a jury verdict. The State alleged that appellant Darrius Robinson entered a retail store, approached a cashier, displayed a firearm, and took money from the cashier. The court granted en banc reconsideration of the order affirming the judgment of conviction.
ISSUES:
The primary issues for reconsideration are: (1) whether the district court erred in denying Robinson’s Batson challenge, and (2) whether the district court erred by allowing the investigating detective to offer opinions without being noticed as an expert witness.

Randolph (Thomas) vs. State (Death Penalty-Direct)

This is an appeal from a judgment of conviction, pursuant to a jury verdict, of two counts of first-degree murder with the use of a deadly weapon and conspiracy to commit murder. Appellant Thomas Randolph was convicted based on evidence that he enlisted Michael Miller to kill his wife Sharon Randolph during a staged burglary in order to collect the proceeds from her life insurance policies and that after Miller shot and killed Sharon during the staged burglary, Randolph then shot and killed Miller.
ISSUES:
The primary issues in this appeal are: (1) whether the district court erred by admitting evidence of Randolph’s former wife’s death and his attempts to arrange her murder; (2) whether sufficient evidence supports the conspiracy-to-commit-murder conviction; (3) whether a pretrial delay of over eight years violated Randolph’s right to a speedy trial; and (4) whether the district court erred by granting the State’s challenges to prospective jurors.
