The U.S. District Court for the District of Nevada certified three questions to this court arising from a tort action seeking damages for wrongful death and negligence per se after a mass shooting.

ISSUES:

Based on open questions of Nevada law, the district court asks (1) whether Nevada courts must find express legislative intent to impose civil liability under a criminal statute to adopt that statute as the standard of care under negligence per se, and (2) two questions as to whether NRS 41.131’s language provides defendant firearm manufacturers and dealers with immunity from plaintiffs’ claims for wrongful death and negligence per se.
