This matter involves legal questions certified to this court by the U.S. District Court for the District of Nevada under NRAP 5.  Appellant brought federal and state law claims against respondents, alleging violations of her civil rights as guaranteed by the U.S. and Nevada Constitutions. After the federal district court denied respondents’ motion for summary judgment on some of appellant’s claims, respondents moved for reconsideration on the ground that no private rights of action under the Nevada Constitution existed for appellant’s state-law claims.

ISSUES:

The U.S. District Court certified the following questions to this court: (1) Is there a private right of action under the Nevada Constitution, Article I, § 8? (2) Is there a private right of action under the Nevada Constitution, Article I, § 18? (3) If there is a private right of action, what immunities, if any, can a state actor defendant raise as a defense? and (4) If there is a private right of action, what remedies are available to a plaintiff for these claims?

The parties collectively appeal from an order resolving a family trust dispute.

ISSUES:

The questions before this court are whether the district court properly denied equitable claims, declined to admit a settlement agreement at trial, and denied a motion to continue trial. The parties also dispute the awards and/or denials of attorney fees and costs.
