Appellants are Las Vegas-based taxi companies who have been adversely affected by legislation passed in 2015 allowing ridesharing companies, such as Uber and Lyft, to operate in Nevada. In 2020, they sued the State of Nevada, alleging that they had a property interest in their taxi licenses that was “taken” from them by virtue of having to compete with ridesharing companies. The district court granted the State’s motion to dismiss appellants’ complaint.
ISSUES:
Issues on appeal: whether (1) appellants have a cognizable property right in their taxicab licenses, (2) whether that property right includes the right to exclude unlicensed competition, (3) the decrease in value of appellants’ licenses amounts to a compensable taking, and (4) appellants’ claims are time-barred.
