Castillo vs. Atkinson Watkins & Hoffman, LLP (Civil)
Docket No. 89421
Carson City – 1:30 p.m. – Panel B26
Jesse Castillo appeals the award of attorney fees to his former attorneys. Castillo was rendered paraplegic as a result of substandard medical care and sued the medical providers. After the medical defendants settled with Castillo, Castillo refused to pay his attorneys more than the cap on professional negligence attorney fees, despite signing fee agreements requiring otherwise. On appeal, Castillo claims that, even though the settlement included claims that were not subject to that statutory cap, the cap should nevertheless apply. He also claims that his former attorneys did not provide him with full disclosure about the fee agreement, and that his former attorneys did not perfect the attorney lien.
Robinson (Maurice) vs. State (Criminal)
Docket No. 89015
Carson City – 2:00 p.m. – Panel B26
Maurice Robinson appeals convictions of elder exploitation, theft, and elder neglect. Robinson was the caregiver of the victim, a 91-year-old retiree. The victim was taken to the hospital with severe ulcers, and the police discovered that Robinson had taken over $70,000 from the victim’s bank account. On appeal, Robinson claims that he should have only been charged with one count of theft and one count of elder exploitation. He further argues that the court erred in issuing a jury instruction that omitted an element of elder neglect. Finally, he argues there was insufficient evidence to convict him of theft, elder exploitation, or elder neglect.
