The Henderson Municipal Court granted appellant City of Henderson’s motion to declare NRS 178.4849 (the statute requiring pretrial bail hearings to occur within 48 hours of an arrest) unconstitutional as violative of victims’ rights enshrined in the Nevada Constitution and separation-of-powers principles. Respondents petitioned for writ relief in the district court.  The district court held that the City of Henderson lacked standing to challenge the constitutionality of NRS 178.4849, the statute did not violate Marsy’s Law or the separation-of-powers doctrine, and the municipal court lacked jurisdiction to declare the statute unconstitutional.  The City of Henderson appeals.

This is an appeal from a district court order dismissing a non-resident corporate defendant for lack of personal jurisdiction. Appellants brought an action for products liability, breach of warranty, and wrongful death against the U.S.-based representative of a foreign manufacturer after an alleged product malfunction in Nevada.  Appellants argue that respondent is subject to specific jurisdiction in this state because respondent introduced its products into the nationwide stream of commerce and regularly attends tradeshows in Las Vegas.  Respondent counters that it has done nothing to target Nevada for jurisdictional purposes and that appellants’ claims therefore do not arise from any Nevada-specific conduct.
